Terms and Conditions

I. General provisions

1. Definitions

a. Company – the operator of the service under the domain sdsoptic.pl, namely SDS Optic S.A., with its registered office in Lublin, at ul. Głęboka 39, 20-612 Lublin, registered in the Register of Entrepreneurs of the National Court Register (KRS) maintained by the District Court Lublin-East in Lublin with its seat in Świdnik, 6th Commercial Division of the National Court Register, under KRS number 0000786821.

b. Service – the website available at www.sdsoptic.pl

c. Contact Form – a section on the Website that allows users to send inquiries to the Company.

d. Newsletter sign-up – a section of the Service containing a form that allows users to subscribe to the newsletter mailing list.

e. Terms and Conditions – this document, specifying the terms of use of the Service and the rights and obligations of Users and the Company.

f. Agreement – an agreement for the provision of electronic services available through the Service, concluded between the Company and the User.

g. Services – services provided electronically by the Company through the Service, including in particular the provision of free content about the Company and the technologies being developed, responding to questions submitted through the Contact Form, and sending newsletters to the email address provided in the Newsletter subscription.

h. Paid service – a service provided by the Company indicated in the Service as paid, with a specified price or requiring individual pricing.

i. User – an adult natural person who uses the Service in accordance with the Terms and Conditions. A user may also be a minor and/or a person lacking full legal capacity, provided that consent is obtained from their legal representative.

j. Privacy Policy – a set of rules regarding privacy, personal data processing, and the use of cookies on the Service.

2. Pursuant to Article 8(1)(1) of the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws No. 144, item 1204, as amended), the Company establishes these Terms and Conditions.

II. Operation of the Service

1. By using the Service, the User enters into an Agreement with the Company and agrees to the terms set out in the Terms of Service and the Privacy Policy.

2. The services available on the Website may be either free or paid. In the case of a paid service, the Company will indicate this information on the specific service page.

3. In the case of paid services, the terms of execution for each paid service will be agreed individually in separate contracts.

4. The Company reserves the right to change the functionality of the Service, particularly by introducing new features and conveniences for Users.

5. The service was created to promote the Company and the technologies it develops, as well as to provide information about current corporate events. By using the Service, the User acquires the right to access published informational and marketing materials, use the contact form, subscribe to the newsletter, and utilize other functionalities according to their intended purpose.

III. Terms of Use of the Service

2. Before using the Service, the user is required to familiarize themselves with the provisions contained in the Terms & Conditions

3. The user is required to provide up-to-date information that is accurate and reflects the actual state of affairs.

4. With regard to the works posted on the Service, Users are obliged to comply with the provisions of the Act of February 4, 1994, on Copyright and Related Rights (Journal of Laws No. 24, item 83, as amended), the Act of April 16, 1993, on Combating Unfair Competition (Journal of Laws 93.47.211, as amended), and the Act of June 30, 2000, on Industrial Property Law (Journal of Laws 2001, No. 49, item 508, as amended).

5. The user agrees to comply with the intellectual property rights (including copyright and industrial property rights, such as trademark rights) held by the Company. The user is solely responsible for any failure to comply with the provisions of this section.

IV. Newsletter Sign-up

1. The moment the contract is concluded in the form of a subscription to the newsletter list occurs when the data entered in the Newsletter Subscription form is approved, at which point the User simultaneously confirms having read the Terms and Conditions.

2. The user has the option to terminate the above agreement with immediate effect, at any time, and without providing a reason by clicking on the deactivation link provided in every email sent by the Company to the User.

Final provisions

1. These Regulations have been in effect since May 10, 2023.

2. The terms and conditions are available to users at the following web address: www.sdsoptic.pl/termsandprivacy

3. The applicable law is Polish law. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code shall apply.

Privacy Policy

Definitions

a. Company / Administrator – the owner of the website under the domain sdsoptic.pl, which is SDS Optic S.A. with its registered office in Lublin, at Głęboka 39, 20-612 Lublin, registered in the Register of Entrepreneurs of the National Court Register (KRS) maintained by the District Court Lublin-East in Lublin, with its seat in Świdnik, VI Commercial Division of the National Court Register under the KRS number 0000786821.

b. Privacy Policy – this document, available on the Service, aims to inform users about what personal data is collected about them, how it will be used, as well as information about cookies and other technologies used on the Service.

c. Service – the online service available at www.sdsoptic.pl

d. Contact form – a section on the Website that allows sending an inquiry to the Company.

e. Newsletter subscription – a section of the Service with a form allowing subscription to the newsletter recipients' list.

f. User – an adult natural person who uses the Service in accordance with the Terms and Conditions. A user may also be a minor and/or a person without full legal capacity, provided that they obtain the consent of their legal representative.

g. GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

Personal data

1. The data controller is SDS Optic S.A. with its registered office in Lublin, at Głęboka 39, 20-612 Lublin, registered in the Business Register of the National Court Register (KRS) maintained by the District Court Lublin-Wschód in Lublin, located in Świdnik, VI Commercial Division of the National Court Register under the KRS number 0000786821, email: office@sdsoptic.pl.

2. The Administrator operates the Service for the purpose of providing information about the Company, current corporate events, as well as the projects and operational activities it is undertaking. The Service also serves as a platform for communication with Users through forms and for presenting the Company’s products and services.

3. The Service performs functions of obtaining information about Users and their behavior in the following ways: (a) through voluntarily entered information in forms; (b) through cookies stored on the User's end devices (so-called "cookies"); (c) through the collection of www server logs; (d) through technologies of external providers indicated in this document.

4. Personal data of the Service Users are processed in accordance with applicable laws, in particular with the Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

5. The data processed by the Administrator are secured against unlawful disclosure to unauthorized persons, unauthorized access, theft, damage, modification, accidental destruction, or loss.

6. The data collected by the Administrator during the submission of a query, order, or use of the contact form by the User, such as: first and last name, company name, phone number, email address, are processed for the purpose of fulfilling contracts concluded with the User, including the agreement for the provision of electronic services, as well as actions taken at the User's request (Article 6(1)(b) GDPR), enabling contact with the Company, and fulfilling a legal obligation imposed on the Administrator (Article 6(1)(c) GDPR).

7. The User's personal data may be processed in connection with the legitimate interests of the Administrator in order to secure and pursue claims (Article 6(1)(f) GDPR).

8. In the case of signing up for the Newsletter, personal data in the form of an email address (including the first name, last name, and employer's name contained in the email address) are processed based on consent for the processing of personal data for marketing purposes in connection with sending emails with current information about ongoing events in the Company and commercial information (Article 6(1)(a) of the GDPR).

9. Providing personal data is voluntary, but required to submit an inquiry, order, use the Contact Form, or subscribe to the Newsletter.

10. The User's personal data provided in the forms on the Service may be shared, in the case of placing an order, depending on the chosen method of delivery and payment, with the postal operator, courier and transport companies, the entity handling online payments, the bank holding the Company's account, and in the case of using the Contact Form, with the supplier of the IT system and hosting service for the Service, or entities providing IT services to the Company.

11. The User's personal data may also be shared with entities providing legal, tax, or advisory services to the Company.

12. The Administrator is responsible for the personal data of Users processed on the Facebook Page on facebook.com (Owner: Meta), LinkedIn, and Twitter.

13. The Administrator processes personal data directly provided by Users.

14. Personal data is stored for the period necessary to: (a) properly provide services delivered electronically (sending newsletters, responding to inquiries); (b) secure or pursue potential claims; (c) comply with a legal obligation imposed on the Administrator.

15. Personal data processed for marketing purposes and other purposes not mentioned above will be processed until the previously given consent for their processing for this purpose is withdrawn or until an objection is raised.

16. The user may also withdraw their consent to receive commercial information at any time by sending an email with the appropriate content to the Administrator at office@sdsoptic.pl.

17. In the event that the Administrator plans to further process personal data for a purpose other than the one for which the data was collected, they will inform the data subject of the new purpose and provide any other relevant information via email before such further processing takes place.

18. Personal data will not be subject to profiling, and no decisions will be made based on it in an automated manner.

No identifying or personal data will be transferred to a third country or international organization unless the User of the Service explicitly indicates in their browser settings that they do not agree to such actions.

20. The user has the right to access their data, correct it, restrict its processing, transfer the data, and, in cases specified by law, request the cessation of data processing, its deletion, or object to its processing. They also have the right to file a complaint with the supervisory authority monitoring compliance with personal data protection laws, i.e., the President of the Personal Data Protection Office.

Cookies

1. The service uses cookies. These files may contain personal data in the form of the IP address of the device used by the User while using the Service and a unique identifier of this device. These files are not stored on the Administrator's servers, and their purpose is to record the User's activity while using the Service. More information about cookies can be found on the website http://aboutcookies.org.

2. Due to the retention period, the cookies used by the Service may be of the following types: (a) 'session' or 'temporary' cookies, associated with the browsing session on the Service, which are stored on the User's device until the website is exited; (b) 'persistent' cookies, saved on the User's device and remaining in the browser's memory after the session ends, unless they are deleted upon the User's request; (c) third-party cookies, originating from servers of entities cooperating with the Service.

3. Due to their purpose, the cookies used by the Service may be of the following types: (a) necessary for the proper functioning of the Service and its individual elements; (b) functional, enabling the website to remember choices made on the Service's pages, including remembering values in form fields entered by the User; (c) performance, aimed at collecting information on how the Service's webpages are used; (d) advertising, used to provide advertising services; (e) analytical, used for statistical purposes."

4. The legal basis for collecting data read from cookies is Article 6(1)(f) of the GDPR, understood as the implementation of the legitimate interest of the Data Controller in maintaining the functionality of the Service, adapting the site to the individual settings of the User, as well as remembering the data entered by the User related to the use of the Service and conducting statistical analyses concerning the Users.

5. The User may opt out of cookie collection by changing the settings of the browser used to access the Service in a manner appropriate for that browser. It should be noted that in such a case, using the Service may become impossible.

6. The User can access the collected cookies stored on the disk or in the memory of the device used to access the Service by analyzing the contents of the cookies in the browser settings.

7. The Administrator does not link operational data and information contained in cookies with any other data that it may possess or have access to.

Other external technologies used

1. The Administrator informs that the following external technologies for monitoring User activities are used on the Service: (a) the Meta Pixel, utilizing cookies provided by Meta Platforms Inc. (formerly Facebook Inc.), 1601 S. California Ave. Palo Alto, CA 94304, USA, for marketing, remarketing, and management of Meta Ads. Details about the use of cookies by Meta Inc. are available at: https://www.facebook.com/privacy/explanation; (b) the LinkedIn Pixel, utilizing cookies from LinkedIn Corporation, 1000 West Maude Ave, Sunnyvale, CA 94085, USA, for marketing, remarketing, and management of Meta Ads. Details about the use of cookies by LinkedIn Corp. are available at: https://www.linkedin.com/legal/privacy-policy; (c) Tools and plugins provided by social media platforms such as Facebook, LinkedIn, Twitter, and YouTube are used for promotion, subscription options, and following the Administrator's profiles; (d) the Google Analytics tracking code provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, for statistical analysis to improve the Service's performance. 2. If the User does not consent to the use of external technology cookies in the Service, they can change the browser settings. It should be noted that disabling or limiting the support for cookies necessary for authentication, security, and maintaining user preferences may make it more difficult, and in extreme cases may prevent the use of the website

3. For the smooth operation of the Service, it is recommended to consent to the use of cookies; however, they can be blocked at any time in the settings of your browser.
